Introduction

Welcome to Evia Health (Pty) Ltd (“Evia Health”). By utilising our services, you agree to the following Terms and Conditions. Please read them carefully.

Service Description

Evia Health provides medication delivery services, including prescription medication dispensing, packaging, and delivery, intended for individuals in need of chronic, acute prescription medications and supplementations.

Use of Service

  • Eligibility: You must be at least 18 years old and legally able to enter into a binding contract.
  • Account Information: Accurate, complete, and updated information must be provided when creating an account.
  • Prescription Compliance: Valid prescriptions must be provided. All medications will be dispensed strictly according to licensed healthcare providers' prescriptions.
  • Payment: You agree to pay for all medications and services, including taxes and delivery fees.

Chronic Medication Support Services

By using Evia Health, you agree that we may pre-pack your chronic medication for delivery or collection to save you time. Send reminders when your prescription is nearing expiry to assist you in obtaining a new script. You may opt-out of these services at any time by contacting us.

Customer Consent

By using Evia Health's services, you expressly consent to the collection, processing, storage, and sharing of your personal and health-related information, including but not limited to prescriptions, medical aid details, and contact information, for the purposes of providing healthcare services, delivery logistics, regulatory compliance, and Customer support. Your information may be shared securely with authorized third-party service providers strictly for service fulfillment, under confidentiality obligations in accordance with the Protection of Personal Information Act, 2013 ('POPIA'). You have the right to withdraw your consent at any time by notifying us in writing. Upon withdrawal, services will cease, and your personal data will be deleted unless retention is required by law.

Customer Declaration

By continuing with registration, placing an order, or submitting a prescription through Evia Health’s platform or partner platforms, I:

  • Confirm that the information provided, including allergies and known medical conditions, is complete and accurate;
  • Acknowledge that Evia Health acts solely as a dispensing pharmacy and does not provide medical advice or clinical evaluations;
  • Confirm that my prescribing healthcare provider is responsible for ensuring the clinical suitability of my medication;
  • Consent to the use and sharing of my personal health data for the purpose of dispensing and delivering medication in accordance with Evia Health’s Terms and Conditions and Privacy Policy;
  • Understand that I may withdraw this consent at any time.

Advice, Counselling, and Customer Declarations

Evia Health endeavours to provide accurate and up-to-date pharmaceutical services in accordance with the Pharmacy Act, 1974 (Act No. 53 of 1974), Medicines and Related Substances Act 101 of 1965, and Good Pharmacy Practice (GPP) standards. Customers acknowledge that it is their responsibility to disclose all relevant medical information to the prescribing healthcare professional, including known allergies, comorbidities, and chronic conditions. Evia Health shall not be held liable for any adverse outcomes or complications resulting from the Customer’s failure to disclose such information or from the prescribing doctor’s omission. Where Evia Health acts as a dispensing pharmacy based on valid prescriptions received electronically or otherwise, the duty to counsel is satisfied through reasonable efforts to highlight Customer safety warnings. However, ultimate responsibility rests with the prescribing professional and the Customer. Evia Health acts solely as a dispensing pharmacy and does not undertake clinical assessments. The prescribing healthcare professional bears sole responsibility for ensuring the medicine is clinically appropriate, taking into account the Customer’s medical history, allergies, and comorbidities. Customers agree to indemnify Evia Health from any claims, liabilities, or damages arising from incomplete or inaccurate medical histories not disclosed at the point of care or prescribing, or from any clinical errors, omissions, or failures on the part of the prescribing healthcare professional.

Privacy and Data Security

  • Data Use: Your information (including prescriptions, medical aid details, and personal identifiers) may be shared securely with authorized third parties strictly for the purpose of service delivery, healthcare coordination, and regulatory compliance.
  • Third-Party Providers: We use vetted third-party service providers for delivery logistics and secure cloud-based data processing. All third parties adhere to strict confidentiality and POPIA compliance standards.
  • Data Analytics: We may use de-identified information for internal analytics and service improvements. Identifiable data will never be shared without explicit consent.
  • Withdrawal of Consent: You may withdraw your consent to data use by contacting us. Upon withdrawal, services will be discontinued, and identifiable data deleted unless retention is required by law.

Account Security

You are responsible for maintaining the confidentiality of your login credentials. Evia Health will not be held liable for losses due to unauthorized use of your account resulting from your negligence.

Product Safety and Disclaimer

While Evia Health takes reasonable steps to ensure product safety and labeling accuracy, no warranties are given beyond those required by law. Customer/s is/are advised to verify labeled ingredients and usage instructions. Unless gross negligence by Evia Health is proven, you indemnify us against any direct, indirect, incidental, or consequential injury, harm, death, or loss arising from the use of our products or services.

Limitations of Liability

Evia Health’s liability for any claim arising from the use of our services is limited to the amount paid for the service in question. We are not responsible for delays, errors, or incorrect deliveries beyond our reasonable control.

Intellectual Property

All content, branding, and materials on our website and platform are the property of Evia Health and protected by applicable intellectual property laws. Unauthorized use is strictly prohibited.

Bundled Service Fees

Evia Health offers certain bundled medical service packages that may include third-party provider charges (e.g., doctor consultations, software/platform access fees, dispensing, and delivery). These are presented as a single inclusive fee for customer convenience. Detailed breakdowns are available upon request. Evia Health affirms compliance with all applicable pricing regulations under the Pharmacy Act, the Medicines and Related Substances Act, and the Consumer Protection Act.

Sales, Pricing, and Stock Availability

All products and services are subject to availability. Prices are quoted in South African Rand (ZAR) and may change without prior notice. VAT adjustments will be applied according to prevailing legislation. Delivery charges apply and will be disclosed at checkout.

Delivery Policy (Intercare Customers)

Orders will be processed for:

  • 1 to 2 medications: 1 to 2 business days;
  • 3 or more medications: Within 2 business days;

Deliveries are limited to South Africa. Deliveries can only take place after Evia Health has managed to contact/counsel the Customer and further, Successful medical aid claim or co-payment.

Delivery Policy (Unu/SBSA Customers)

Orders will be processed within 2 hours of receipt of script from Intercare Doctor. Deliveries are limited to certain areas within Johannesburg, South Africa. Deliveries can only take place after Evia Health has managed to contact/counsel the Customer.

Delivery Policy (Evia Health Prescription/Supplement & BrandMed Customers)

Orders will be processed within 3 business days of receipt of payment. Deliveries are limited to South Africa. Deliveries can only take place after Evia Health has managed to contact/counsel the Customer and further, Successful medical aid claim or co-payment.

Export Restriction

Services are available to South African residents only.

Any third-party links are provided for convenience only. Evia Health does not endorse or accept responsibility for external sites' content.

Trading Hours

  • Monday to Friday: 8:30 a.m. – 5:30 p.m
  • Saturday: 8:30 a.m. – 1:00 p.m.
  • Closed: Sundays and public holidays.

Legal Jurisdiction

These terms are governed by the laws of South Africa. Evia Health chooses 33 Fricker Road, Illovo, Johannesburg as its domicilium citandi et executandi.

General Legal Provisions

  • Non-Waiver Clause: Failure by Evia Health to enforce any provision of these Terms and Conditions shall not constitute a waiver of such provision or affect Evia Health’s right to require performance at any subsequent time.
  • Severability Clause: If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

Changes to Terms

Evia Health reserves the right to amend these Terms and Conditions at any time. Updates will be posted on our website.
